Child pornography charges dismissed in Rockdale County

Our client was indicted in Rockdale County Superior Court and charged with several counts of possession of child pornography.

The evidence was discovered by the GBI as a result of the execution of a search warrant for our client’s computer. The search warrant was issued by a Rockdale County Magistrate Judge.

During our investigation, it was learned that our client’s computer was actually at the GBI office in Decatur at the time the search warrant was issued. Therefore, we filed a Motion to Suppress the computer evidence alleging that the Rockdale County Magistrate did not have jurisdiction to issue the search warrant since our client’s computer was not located within the county. Prior to arguing the Motion, the District Attorney reluctantly agreed with our argument and dismissed the case.
