Bartow County grand jury dismisses statutory rape and molestation charges

Our client was charged with statutory rape and child molestation for engaging in consensual sexual intercourse with a 15-year-old girl.

Our investigation revealed that the girl instigated the sexual activity with our client and even told several of her friends that she lied about her age. We learned that she was dating several guys who were over the age of 18.

The client was 24 years old but suffered from mental health issues that rendered him both intellectually and socially challenged. We sent him for a psychological evaluation that revealed that his mental functioning was on the level of an 11-year-old child. This helped to explain why his best friend was 17 and why he was hanging out with girls who were only 15 years old. As a result of our client’s condition, he had a very low IQ and suffered from extreme depression.

We presented our findings to the district attorney’s office and spent over a year trying to convince them to dismiss the case. Eventually, the district attorney’s office presented all of the evidence (including the results of our investigation) to the grand jury which voted to “No-Bill” the case. As a result, the charges against our client were dismissed and the arrest will be expunged from his record.
