Sex offense cases are unique and require specialized knowledge and tactics that are not often employed in the defense of other criminal cases. For instance, there are particular evidentiary rules that apply only to these types of cases such as the Child Hearsay and Rape Shield statutes.
The Child Hearsay statute allows the prosecution to introduce certain hearsay statements of children under the age of 16. The most critical statements are the ones obtained during the forensic interview of the child. The interviewers will often engage in suggestive and improper techniques that can lead to false allegations of abuse. Fortunately, the forensic interviews are usually videotaped which allows our experts to critically examine the questioning and techniques utilized by the interviewer.
The Rape Shield statute generally limits our ability to introduce evidence concerning the prior sexual conduct of an alleged victim. There are several exceptions to this rule and a well drafted pretrial motion is required in order to introduce such evidence that may fall within one of these exceptions.
In child pornography cases, many of our clients are charged as a result of an accidental or unintentional download of unwanted computer files. We work with some of the top computer forensics experts in the field who examine our client’s hard drives and then methodically piece together the computer data that recreates the timeline of activity surrounding the downloading of the unwanted file.
